Comments on Proposed Definition of “Waters of the United States” Docket ID Number EPA-HQ-OW-2025-0322
The Izaak Walton League of America strongly opposes the proposed revision to the definition of “Waters of the United States,” arguing that it would significantly weaken Clean Water Act protections critical to public health, ecosystems, and the economy.
The League contends that the proposal would remove federal safeguards from millions of acres of wetlands and countless streams, despite the fact that agencies already appropriately adjusted the rule following the Supreme Court’s Sackett v. EPA decision. The League warns that vague and undefined terms in the proposal would create regulatory confusion for landowners and agencies alike.
The comments emphasize that excluding ephemeral and intermittent streams would jeopardize drinking water supplies and harm ecosystems, particularly in arid regions.
The League also highlights the essential role wetlands play in flood control, water filtration, biodiversity, and outdoor recreation. Ultimately, the League urges the EPA and Army Corps to withdraw the proposal and maintain the 2023 rule, which it argues better reflects science, legal precedent, and congressional intent.
